Vacation Rental Agreement for 086 Clam A'Lot

TRAVEL PRESERVER (TRIP INTERRUPTION)   INSURANCE IS AUTOMATICALLY ADDED TO THE FIRST ADVANCE RENT PAYMENT DUE AMOUNT. TO DECLINE COVERAGE, STRIKE THROUGH THE LINE ITEM, INITIAL WHERE INDICATED AND DEDUCT THE INSURANCE AMOUNT WHEN MAKING THIS PAYMENT. INSURANCE IS STRONGLY RECOMMENDED TO COVER SITUATIONS FROM WHICH YOU MAY NOT RECOVER YOUR VACATION INVESTMENT DUE TO ILLNESS, ACCIDENT, MANDATORY EVACUATION, OTHER ACTS OF GOD, ETC. IT CANNOT BE ADDED AFTER YOUR INITIAL PAYMENT IS RECEIVED. PLEASE BE ADVISED, IN THE EVENT OF A MANDATORY EVACUATION, YOU WILL NOT RECEIVE A REFUND FOR ANY PORTION OF YOUR VACATION IF YOU DECLINE THE INSURANCE.

I UNDERSTAND THAT ANY MONIES COLLECTED IN RELATION TO THE RENTAL PROPERTY DESCRIBED ABOVE WILL BE PLACED IN AN INTEREST BEARING TRUST ACCOUNT WITH BANK OF AMERICA, SUNSET BEACH, NC. SUNSET VACATIONS, LLC WILL BE ENTITLED TO ALL ACCRUED INTEREST.

1. THE LESSEE FULLY UNDERSTANDS THAT SUNSET VACATIONS is a rental agency engaging in the rental of private property to others. Sunset Vacations, LLC reserves the right to refuse service to anyone this agency feels will not be responsible for the property he/she is renting. Sunset Vacations, LLC will not rent to anyone under the age of 25. Each rental unit requires a person 25 or older to lease and sign the rental contract. This person must also be present at check-in. Sunset Vacations is not responsible for the loss or theft of clothing, money, jewelry, etc., and is not to be held liable for any accidents or injury of any nature. Sunset Vacations, LLC reserves the right to move any reservation that might come about due to any unforeseen circumstance (house sold, out of rental system, owner's use, act of God, etc.). Under no circumstances is the obligation of this agency more than that of refunding lessee's deposit. Any property damage will be billed to the lessee. Lessee understands that Sunset Vacations, LLC has the right to terminate this agreement, re-enter the unit or take necessary measures to remove lessee from the premises in the event lessee violates the conditions of this agreement. If at the time the tenant is to begin occupancy of the property, the landlord or agent cannot provide the property in a fit and habitable condition or substitute a reasonable comparable property in such condition, the landlord and agent shall refund to the tenant all payments made by the tenant.

2. CHECK-IN is 3:30 P.M. Rental week is Saturday to Saturday, unless otherwise stated. Any reservations for less than four (4) nights (off-season, value season), is subject to change.

3. CHECK-OUT is prior to 10:00 A.M. Should this check out time be violated, you will be charged for an additional day's occupancy. Lessees agrees upon check out to: remove bed-linens and replace bedspreads/comforter, wash and put away dishes, take out all trash and pull large trash can to the street, lock all windows and doors, return keys to Sunset Vacations, LLC office.

4. OCCUPANCY: The State of North Carolina and Brunswick County Health Department imposes the regulation of only two (2) guests per bedroom where homes are served by on-site septic systems. In the unlikely event of a system failure, if the number of your party exceeds the maximum allowable occupants as imposed by the Brunswick County Health Department, you could be subject to eviction or replacement to other more suitable unit(s). Overcrowding of our units is not allowed, and should this occur, you will be subject to eviction.

5. ABSOLUTELY NO HOUSE PARTIES OR PETS* ARE ALLOWED. SHOULD EITHER OCCUR, YOU WILL BE EVICTED. Should a pet be found inside or outside your premises that is not deemed Pet Friendly, your deposit will be automatically forfeited in addition to your eviction.

6. Damage Deposit: We appreciate our rental guests, many who have been vacationing with us for generations! Therefore, we do not require a damage deposit, but instead offer our No Worries Program, outlined below. Should you not purchase the No Worries Program, you will be required to pay a damage deposit of no less than $300.00 per reservation. SECURITY/DAMAGE DEPOSITS WILL BE RETURNED WITHIN 45 DAYS OF YOUR DEPARTURE.

7. No Worries Program: Under this program (weekly rentals only), you will not be held responsible for accidental loss of damage to the rental property resulting from yourself or others in your party for up to $2, 000. Please report all damage that you notice upon check-in. Failure to do so could result in the No Worries Program becoming voidable. Should any damage occur during your stay, please notify our office immediately in writing. Your participation in the No Worries Program does not relieve your responsibilities as a tenant. You will be held responsible for obvious acts of neglect and any malicious damage and/or theft. Also, in the event proper check-out procedures are not followed, you will be subject to additional charges. Please note: We inspect every home after each party’s departure. EXCEPTIONS TO THE NO WORRIES PROGRAM: Some homes do not offer the No Worries Program. In these few instances, a traditional security/damage deposit will be required. Also, in the event of rentals less than one week and *PET FRIENDLY homes, the traditional security/damage deposit will be required. *Additional fees may be required on our Pet Friendly homes.

8. GRILLING-Is not permitted on any decks, porches or walkways, and should only be done away from the house itself and/or any structure.

9. LOCK-OUT POLICY-You will be given two (2) keys upon check-in. If during your stay you become locked out, you may pick-up a spare key during business hours from the office. After hours, one of our agents will meet you at the office to provide you with a key. There is a $30.00 charge for this service.

10. DEPARTURE CLEANING-Is provided by the owner and included in the majority of our weekly rental homes. In the event your reservation does not include the departure maid service and you elect to clean the unit yourself and it is left in an unacceptable condition, your damage deposit will be used for any and all recovery.

11. REPAIRS AND SERVICE CALLS-Please report any inoperative equipment to our office promptly. We cannot guarantee appliances, TV's, air conditioners, etc. and no refund or rate adjustment will be made for any mechanical failure. We will however, make every effort to have repairs done quickly and efficiently.

LONG DISTANCE TELEPHONE CALLS-should be done by either calling card or credit card. Should any long-distance calls be made, you will be billed for the call plus a $20.00 service charge. THE ONLY LOCAL EXCHANGES FROM SUNSET BEACH ARE 579, 575, 754, 755, 842, 845, 846, 253 & 287.

12. MAIL-Sent in care of Sunset Vacations may be picked up at our office.

13. LINENS, towels, sheets and pillowcases are not provided. You must provide these items. You may however reserve these items from Julie’s Rentals 1-910-579-1211 or CARE Linen Service 1-910-619-7190.  

14. ADVANCE rental deposit will be applied to the total rent. In the event of a cancellation, the deposit will be refunded (less $50.00 handling fee), provided the rental unit has been re-rented for the entire time of your reservation. In the event that a credit/debit card has been used, your card will be charged for any remaining balance associated with your rental agreement.

15. RETURNED checks are subject to a $30 fee.

16. SUNSET VACATIONS, LLC is the agent for the owner and does not carry insurance on the rental units. Therefore, it cannot accept any liability for injury to renter or other persons which may occur on the premises.

I HAVE READ THE RULES AND POLICIES STATED ON BOTH THE FRONT AND BACK SIDE OF THIS AGREEMENT AND AGREE TO ABIDE BY THEM AND ALL PERSONS OCCUPYING THE UNIT DURING THE LEASE ALSO AGREE TO ABIDE BY THE RULES AND POLICIES SET FORTH
